Why independent legal advice matters
Most problems we see in foreign property purchases — undisclosed mortgages, buildings without a habitation certificate, deposits paid on properties the seller could not legally transfer — were avoidable with a proper check before signing. Estate agents and developers have their own interests in the transaction. An independent lawyer's only interest is protecting yours.
How a safe purchase works
Before any money changes hands, we examine the title deed record, encumbrances, zoning status, building permits and the habitation certificate, and verify the seller's authority to sell. You receive a written due diligence report. Only then do we negotiate and sign the sales contract, ideally with payments tied to verifiable milestones. The transfer itself takes place at the Land Registry, where foreign buyers additionally need an official valuation report and, where applicable, a sworn interpreter.
Citizenship by property investment
Foreign nationals who purchase real estate worth at least USD 400,000 — subject to a three-year no-sale commitment registered on the title — may apply for Turkish citizenship. The procedure involves strict documentation, including an approved valuation report and foreign-currency exchange certificates. Göcek, Ölüdeniz and the marina villages
Göcek deserves separate mention. With six marinas and a villa stock largely in foreign ownership, the disputes we handle there differ from the rest of the district: berthing and winter storage contracts, refit and repair defects, charter cancellations, and villa purchases where the building predates its habitation certificate. Ölüdeniz, Ovacık and Hisarönü bring a different mix — short-term holiday letting, site management charges and boundary questions on hillside plots. Inheriting Turkish property as a foreign heir
Turkish law governs real estate located in Turkey, which means your home-country will does not by itself transfer a Fethiye or Göcek property to your heirs. Heirs need a Turkish certificate of inheritance; where a foreign court has already ruled on the estate, that decision must be recognised and enforced in Turkey before the Land Registry will act. Planning this in advance — while you still own the property — is considerably cheaper than resolving it afterwards.
